Ms. Atzberger represents clients and their families who are seeking help with obtaining services for students with disabilities. She assists families with requesting evaluations to determine if a child is eligible for special education services and works with school districts in the development of IEP's and 504 Plans. She also assists families with filing complaints with the Ohio Department of Education and the Department of Education, Office of Civil Rights when a school district fails to provide the disability services that a child is entitled to receive, or fails to follow the child's IEP or 504 Plan.
She also represents students in suspension and expulsion hearings, and appeals of these decisions to school boards and the Court of Common Pleas.
JUVENILE AND CRIMINAL LAW
Ms. Atzberger provides legal representation to juveniles charged with delinquency complaints and to adults who have been charged with misdemeanor or felony complaints. She represents clients in all stages of the proceedings, including: arraignment, pretrial, trial and sentencing. She has expertise in representing juveniles charged with serious crimes who may be subject to transfer to the adult criminal system or who may be required to register as a juvenile sex offender.
CIVIL RIGHTS LAW
Ms. Atzberger represents children and families in a select number of cases where serious civil rights violations have occurred within the school setting. These violations include failure to comply with the IDEA, Section 504 of the Rehabilitation Act, the Americans with Disabilities Act, and the Civil Rights Act of 1964.
